Terms Of Use

These terms govern your use of avorz.com, its feeds and its account area. By using the site you accept them. If you do not accept them, do not use the site.
1. Who provides this service
avorz.com is operated by a company established in the European Economic Area. Our corporate identity, registered address and company number are provided on request to contact@avorz.com and are set out in full in our licensing agreements. Nothing in these terms limits the information you are entitled to receive as a consumer under applicable law.
2. Access to the wire
The wire is free to read in full. There is no paywall, no metering, no registration wall, and no material reserved for account holders. We do not charge readers and we do not intend to.
An account is optional. It adds saved items, followed tags and the newsletter, and nothing else. You may read everything without one.
We may change, suspend or discontinue any part of the service. Where we discontinue the account system, holders will be given advance notice and the opportunity to export their data.
3. Accounts
- Accounts are for individuals aged 16 or over. One account per person.
- Sign-in links are single-use and time-limited. Anyone with access to your email can access your account, so keep that mailbox secure.
- You are responsible for activity carried out through your account.
- You may delete your account at any time from the account area, without contacting us and without giving a reason.
- We may suspend or close an account used for automated harvesting, circumvention of limits, or conduct prohibited by section 5. Except where a delay would cause harm, we give notice and an opportunity to export first.
4. Intellectual property, quotation and reuse
Wire copy, the arrangement of the feed, the site design and the avorz name and mark are protected by copyright and trade mark law. Rights in third-party material referred to in an item remain with their owners.
Quotation is permitted without asking us. You may reproduce a headline and a short extract of an item, provided you attribute it to avorz and link to the item. This covers ordinary journalistic, academic, and social sharing use, and reflects the quotation exceptions in Article 5(3)(d) of Directive 2001/29/EC and the fair use doctrine under United States law.
A licence is required for anything systematic: reproducing full items or substantial extracts, republishing the feed or any material part of it, incorporating wire copy into another product or terminal, or maintaining a searchable archive of our items. Write to contact@avorz.com.
Text and data mining rights are expressly reserved. Pursuant to Article 4(3) of Directive (EU) 2019/790, we reserve all rights to carry out reproductions and extractions from this site for text and data mining, including for the development, training, fine-tuning, evaluation or grounding of machine learning systems and generative artificial intelligence models. This reservation is made in machine-readable form in the site’s robots.txt file and applies whatever the method of retrieval, including retrieval through a third-party crawler, proxy, dataset or archive. Any such use requires a separate written licence.
If you hold a licence, republishing an item without its subsequent revisions and corrections is a breach of that licence: our items are living records and the correction history is part of the work.
5. Acceptable use
- Automated retrieval is permitted within our published rate limits. The feed at avorz.com/feed.xml exists so that polling the site is unnecessary; use it in preference to crawling.
- Do not circumvent rate limits, access controls or technical restrictions, and do not retrieve at a rate that degrades service for other readers.
- Do not present the wire, or a derivative of it, as your own product or as endorsed by us.
- Do not alter a headline, figure, timestamp or attribution while presenting the result as an avorz item. Misrepresenting our reporting is a misuse of our mark and, in some jurisdictions, a criminal matter.
- Do not use the site to distribute malware, to attempt unauthorised access, or to interfere with its operation.
- Security research is welcome. Report findings to contact@avorz.com rather than demonstrating them against live systems or other readers’ accounts. We will not pursue researchers who act in good faith, stay within these limits, and give us reasonable time to remediate before disclosure.
6. What we do not promise
The wire is filed against the standards published at avorz.com/editorial-standards/, and we take those standards seriously. They are commitments about how we work; they are not warranties given to you as terms of a contract.
To the maximum extent permitted by law, the service is provided “as is” and “as available”, and we exclude all implied warranties, including warranties of merchantability, fitness for a particular purpose, accuracy, completeness, timeliness and non-infringement.
- Nothing on the wire is investment, financial, legal, tax, medical or other professional advice, and no item is a recommendation to buy, sell or hold anything. Decisions you take on the basis of an item are yours.
- Items may be revised or corrected after filing. Relying on an item without checking its current state is a risk you accept.
- Continuous availability is not guaranteed.
- Where we link to a third-party site, we do not control it and are not responsible for its content or its practices.
7. Liability
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for loss of profit, revenue, data, goodwill or anticipated savings, arising out of or in connection with your use of the site.
Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited. If you are a consumer, your mandatory statutory rights are unaffected by these terms, and nothing here requires you to give them up.
Because we charge readers nothing, our aggregate liability to you in connection with the free use of this site is limited, to the extent the law allows, to one hundred euro. Where you hold a paid licence, liability is governed by that licence rather than by this section.
8. Your responsibility to us
If you use the site in a business capacity and breach section 4 or section 5, you agree to indemnify us against claims, losses and reasonable legal costs arising from that breach. This section does not apply to consumers.
9. Changes to these terms
These terms are versioned and dated. We will announce material changes to account holders by email before they take effect, and will publish the change here in advance. Continuing to use the site after a change takes effect means the version then in force applies to that use. If you do not accept a change, stop using the site and, if you wish, delete your account.
10. Governing law and disputes
These terms and any non-contractual obligations arising from them are governed by the law of the European Economic Area state in which the operator is established.
If you are a consumer in the EEA or the United Kingdom, this choice of law does not deprive you of the protection of the mandatory rules of the country where you habitually reside, and you may bring proceedings in the courts of that country. We will bring any proceedings against you only in the courts of your country of residence.
If you are in the United States, we ask you to write to contact@avorz.com before commencing proceedings, setting out the dispute and the resolution you seek. We will respond within 30 days and will attempt in good faith to resolve the matter informally. This does not prevent either party from seeking urgent injunctive relief. Nothing in these terms constitutes a waiver of your right to bring an individual claim in small claims court.
If you are a business user, disputes are subject to the exclusive jurisdiction of the courts of the operator’s place of establishment.
11. General
- Severability. If any provision is held unenforceable, the rest remains in force and the provision is applied to the maximum extent permitted.
- No waiver. Not enforcing a provision on one occasion is not a waiver of it.
- Assignment. You may not assign your rights under these terms. We may assign ours to a successor operator of the service, on notice to account holders.
- Force majeure. Neither party is liable for failure to perform caused by events beyond its reasonable control.
- Entire agreement. These terms, together with the privacy policy and any licence you hold, are the whole agreement between us about the site.
- Language. These terms are published in English. A translation is provided for convenience only, and the English text governs.
